Ignorant girls are caught in the black hole of "Jiali Loan"
20-year-old Xiaonan (pseudonym) works as a waiter in a KTV in Changsha. Although his income is not low, he is used to the high consumption in entertainment places. Xiaonan’s living expenses are very high and he can’t make ends meet every month. One day, Xiaonan accidentally saw a loan advertisement in WeChat circle of friends: "No mortgage, low interest, fast loan". She was worried about the rent. After several contacts, the "intermediary" took her to a boss named Wen Chen.
Seeing that Xiaonan is young and beautiful and works in KTV, Wen Chen speaks very politely: "Borrow 10,000 yuan, interest 200 yuan a day, overdue penalty 1,000 yuan a day, and the loan period is one month." Xiaonan thought that this interest standard should be no problem with his own ability, and he signed the blank loan agreement without much thought. Unexpectedly, Wen Chen went on to say that if he borrows 10,000 yuan, he will return a "service fee" of 3,000 yuan. Seeing peony hesitated a little, Wen Chen immediately said that this was the rule of their profession, and everyone operated like this. Peony had to agree to Wen Chen’s request.
Unexpectedly, this is not over yet. Wen Chen told Xiaonan that because she had no fixed address in Changsha, she had to take a nude photo as a guarantee. Xiaonan’s experience is the epitome of many victims of "Jiali Loan". "Night girls use money quickly and come to money quickly. They are all afraid that their families will know that they are in this business and feel disgraced, so it is easier to control. " Liu Pingan, a member of Wenchen criminal gang, said.
It is precisely because of the lack of social experience, earning ability and easy control of women working in night shows and KTV. Since March 2017, Wen Chen has gathered Wenwu, Liu Pingan and others to launch the so-called "Jiali Loan" for women working in night shows and KTV in various regions of Changsha. Lure the victim to borrow money under the guise of "low interest, no mortgage, fast loan", and defraud the victim’s property through a series of "routines" such as taking nude photos, inflating the loan amount, signing yin-yang contracts, and charging high interest. As of the time of the incident, the criminal gang has "lent" more than 1,100 times to more than 700 murdered women, with a loan amount of more than 10 million yuan and an illegal profit of more than 3 million yuan.
The victim became a tool for criminals to collect money.
"I will take you to see ‘ tonight. General manager Jiang ’ … …” The victim Xiao Fei (a pseudonym) still couldn’t help shivering when she mentioned that unbearable experience.
In the first half of 2017, Xiaoyan borrowed 38,000 yuan from Wenchen, but the loan contract amount was as high as 85,000 yuan. Unable to bear the constant collection and harassment of Wen Chen and others, Xiao Fei began to hide from Wen Chen. Unexpectedly, "miraculous" Wen Chen "caught" her in her place of residence a few days later.
That evening, Wen Chen, Wen Wu and others took Xiao Fei to the Xiangjiang River. Wen Chen pointed to the Xiangjiang River and said to her, "This is ‘ General manager Jiang ’ 。”
Then Xiao Fei was forced to take off her clothes and walk towards Jiangxin. Xiao Fei was so scared that she knelt down and begged for mercy. First, the victims and their families are forced to submit to repayment by means of violence or soft violence such as threats and intimidation, going to their hometown to visit their homes; Then there is the transfer of single accounts between the same industries, which is called ‘ Unset ’ , transfer the victim to other ‘ Jialidai ’ Gang, ‘ Unset ’ After the victim’s debt is often greatly increased. In April 2018, Wen Chen, who ended compulsory detoxification, quickly returned to his old business and reconvened members of gangs such as Liu Ping ‘an, Wenwu and Liu Pengwei. On the one hand, we will continue to increase investment, and at the same time, we will set up two lending branches: "Win Wo Wealth" and "Chengxin Venture"; On the one hand, the gang members were constantly recruited, the division of labor and structure were adjusted, and the gang was divided into three groups: marketing group, bill review group and collection group, and a clear organizational discipline and salary system were formulated. The criminal chain behind the interest chain
From the second half of 2017, Wen Chen and others began to force the victims to sit in some KTV and sauna places and engage in prostitution, and provided "peripheral" services through WeChat publicity. After a long time, Wen Chen gradually became dissatisfied with this "profit" model of tinkering around the edges.
In the second half of 2018, Wen Chen, who has been hanging out in the night show all the year round, met Ye Jing, the manager of "Yulan Team". "Feather Blue Team" is an organization that specializes in training and providing staff for large KTV and bars, and has a fixed cooperative relationship with many night shows. With the help of the resources of Ye Jing and others, Wen Chen Jianli played a stable "lending — Prostitution "criminal chain.
On the one hand, Wen Chen forced the victims to stay in centralized accommodation, arranged special personnel to take care of them, and formulated a strict attendance system for commuting. For disobedient victims, they are punished by threats, fines, corporal punishment and other means to ensure the "absolute obedience" of the victims. On the other hand, the backbone members of the gang are arranged to be divided into groups according to films, and each group leads a certain number of victims to station in some KTV to carry out stage-sitting and prostitution activities. During the peak period, there were 20 victims under the centralized control of Wen Chen.
In January 2019, Wen Chen met Xiao Yongle, the leader of another large-scale "Jiali Loan" criminal gang in Changsha, and cooperated with him to engage in transnational prostitution crimes.
Electronic data becomes the breakthrough of the case.
In March 2019, Changsha public security organs concentrated on collecting nets from Wen Chen and other "Jiali Loan" gangs, and more than 20 members of Wen Chen’s gang were all arrested and brought to justice. Under the unified leadership of Changsha City Procuratorate, Furong District Procuratorate sent three post prosecutors to form a task force to intervene and guide the public security organs to investigate in advance.

At the same time, these gangs usually do not have a complete financial account book for lending, and the suspect’s guilty attitude is very poor, making it extremely difficult to handle the case. " According to the prosecutor, "it is difficult to find out the facts according to the conventional evidence collection methods, and we must find another way."
In the process of early intervention, the task force found that many people involved in the case talked about WeChat contact, photos and other issues, and the task force was keenly aware that electronic data might become an important breakthrough in this case.
But the problem followed.
Searching for evidence in the huge electronic data is undoubtedly looking for a needle in a haystack. In order to sort out useful information as comprehensively and quickly as possible, the task force first instructed the public security organs to divide the electronic data into "important grades" according to the status and division of labor of each member, and then preliminarily classified and located the electronic data content based on the main crimes such as "routine loan", prostitution and triad-related crimes.
Hard work pays off. After more than 60 days of careful combing, the task force screened out more than 30 victims who could be identified. "The public security organs quickly contacted these victims to make transcripts, and accordingly retrieved relevant WeChat and Alipay transfer records."
These evidence materials not only enrich the evidence system of the crime of illegal lending and organizing and forcing prostitution by Wen Chen gang, but also lead to the fact that Wen Chen and others committed rape and forced indecency.
In the stage of examination and prosecution, the task force found that some victims mentioned that they had been forced to have sex with Wen Chen and others, but Wen Chen and others denied all this, claiming that the two sides had sex "voluntarily". Due to the lack of direct evidence, the public security organs did not identify the criminal facts of rape and compulsory indecency when transferring them for examination and prosecution.
"Most of the victims in this case were illegally treated by Wen Chen and others for a long time ‘ Control ’ Out of professional sensitivity, we believe that Wen Chen and Liu Pengwei are very likely to be involved in crimes such as rape. " The prosecutor said.
In order to find out the facts, the task force compiled a detailed outline of evidence collection, investigated and collected evidence by itself and guided the public security organs to investigate. While continuing to talk to the people involved, we can verify whether the relevant victims have been forced into prostitution and whether there are so-called "debt forgiveness", while continuing to mine useful information from electronic data. By reinforcing the evidence materials in a targeted way, the procuratorial organ finally added the criminal facts of six rapes and two forced indecencies by Wen Chen and others.
In the investigation stage, Liu Pingan, an important member of Wenchen Gang, has always denied participating in the criminal acts of gang organization and forced prostitution.
"In the trial, the defendant Liu Pingan still refused to plead guilty in an attempt to escape his guilt. What he didn’t expect was that we had already prepared. " The prosecutor in charge said, "We were thinking about changing our thinking and starting with Zhang Min who cooperated with Liu Ping-an."
Taking Zhang Min as a breakthrough, the task force decided to talk to Zhang Min many times about the WeChat contact "A Chengmei Medical" who sent girls abroad for prostitution, which was Liu Ping ‘an.
On May 18th this year, Changsha City Procuratorate prosecuted 27 people, including Wen Chen, for allegedly organizing, leading and participating in underworld organizations, fraud, extortion, organizing and forcing prostitution, illegal detention, robbery, rape, assisting in organizing prostitution, and forcing indecency. On September 14th, Changsha Intermediate People’s Court made a first-instance judgment, and sentenced Wen Chen, the ringleader of the gang, to life imprisonment, deprivation of political rights for life, and confiscation of all property. The remaining defendants were all convicted. After the judgment of the first instance, Wen Chen and others appealed, and the case is currently being tried in the second instance.
