The tariff adjustment in 2022 mainly involves the adjustment of provisional tax rate, most-favored-nation tax rate and agreed tax rate, as well as the revision of tariff and the adjustment of tax items. In addition, China will continue to implement preferential tax rates for the least developed countries.

From January 1, 2022, China will impose a provisional import tax rate lower than the most-favored-nation tax rate on 954 commodities. In the adjustment of the provisional import tax rate, a series of highlights attract people’s attention. In order to reduce the economic burden of patients, zero tariff was imposed on radium chloride injection, a new anticancer drug, and the import tariff on some medical products such as intracranial embolectomy stents and artificial joints was reduced. According to China’s gross domestic product (GDP) accounting and data release system, annual GDP accounting includes two steps: preliminary accounting and final verification. Recently, according to the statistical annual report of the National Bureau of Statistics, the final accounts of the Ministry of Finance and the annual financial data of relevant departments, the National Bureau of Statistics has finally verified the 2017 GDP data, and the main results are as follows:

After final verification, in 2017, the total current GDP was 82,075.4 billion yuan, a decrease of 636.7 billion yuan compared with the preliminary accounting; Calculated at constant prices, it increased by 6.8% over the previous year and decreased by 0.1 percentage point compared with the preliminary accounting. 1. Overview of annual GDP accounting

1.1 Basic concepts

GDP is the final result of the production activities of all permanent units in a country in a certain period of time. GDP is the core index of national economic accounting, and it is also an important index to measure a country’s economic situation and development level.

There are three methods of GDP accounting, namely, production method, income method and expenditure method, which reflect the results of national economic production activities from different angles. Production method is a method to get added value by excluding intermediate goods and services from the value of goods and services created in the production process. The formula for calculating the added value of production method in various industries of national economy is as follows: added value = total output-intermediate input. Add up the added value of production method in various industries of the national economy to get the GDP of production method. The income method is to account for the results of production activities from the perspective of income generated by the production process. According to this calculation method, the added value consists of four parts: workers’ remuneration, net production tax, depreciation of fixed assets and operating surplus. The calculation formula is: added value = remuneration of workers+net production tax+depreciation of fixed assets+operating surplus. The sum of the added value of income method in all industries of the national economy is equal to the gross domestic product of income method. Expenditure method is a method to calculate the gross domestic product from the perspective of the final use of production activities. Final use includes final consumption expenditure, total capital formation and net export of goods and services.

Constant-price GDP is to convert GDP calculated at current price into value calculated at a fixed base period price, so as to eliminate the influence of price change factors and make the values in different periods comparable.

1.2 Accounting Scope

1.2.1 Production scope

The production scope of GDP accounting includes the following four parts: first, the production of goods or services provided or prepared by producers to other units; Second, the self-sufficient production of all goods formed by producers for their final consumption or fixed capital; Third, the self-sufficient production of knowledge carrier products by producers for their final consumption or the formation of fixed capital, but it does not include similar activities undertaken by household departments; Fourth, the housing services provided by self-owned houses and the self-sufficient production of family and personal services provided by paid family service personnel. The production scope does not include unpaid family and personal services, natural activities without unit control (such as the natural growth of wild, uncultivated forests, wild fruits or berries, and the natural growth of fish in the high seas).

1.2.2 Main scope of production activities

The main scope of GDP production activities includes all permanent units with economic interest centers within the economic territory of China. The annual GDP data in this report is the national data accounted by the National Bureau of Statistics, excluding the regional GDP data of Hongkong, Macao Special Administrative Region and Taiwan Province.

1.3 Accounting Unit

GDP accounting mainly takes corporate units as accounting units. In accounting, corporate units are divided into different industries according to their main activities, and the added value of each industry is calculated separately, and then the added value of each industry is summarized to get GDP.

1.4 Accounting Steps

According to the requirements of the timeliness of GDP accounting, China’s annual GDP should be accounted for twice, the first is the preliminary accounting of GDP, and the second is the final verification of GDP, and the results of each accounting will change.

1.4.1 Preliminary accounting

Since China’s quarterly GDP accounting adopts the cumulative accounting method before 2015, the preliminary accounting number of GDP in the first four quarters is the preliminary accounting number of annual GDP. From the third quarter of 2015, China’s quarterly GDP accounting was changed to quarterly accounting, that is, the GDP data of the first quarter, the second quarter, the third quarter and the fourth quarter of each year were calculated respectively, and the preliminary annual GDP accounting was obtained by adding the quarterly GDP data. The preliminary accounting of annual GDP shall be completed before January 20th of the following year.

1.4.2 Final verification

The final verification of annual GDP is completed in January of the following year. The reason for the final verification of annual GDP is that more comprehensive and reliable basic data have been obtained, including the professional statistical annual report of the National Bureau of Statistics, the annual financial statistics of departments, and the financial final accounts. Using these data, the added value is calculated by industry using production method or income method.

1.5 Legal basis and system provisions

GDP accounting strictly abides by the provisions of the Statistics Law of the People’s Republic of China. At present, China’s GDP is calculated according to the requirements of China National Economic Accounting System (2016), which adopts the basic accounting principles, contents and methods of the United Nations National Accounts System (2008).

1.6 confidentiality

According to Article 9 of Chapter I of the Statistics Law of the People’s Republic of China, statistical institutions and statisticians shall keep confidential the state secrets, business secrets and personal information they know in their statistical work.

National accountants keep the unpublished professional statistical data and administrative records strictly confidential when conducting GDP accounting, and also keep the current GDP data strictly confidential before the release of GDP accounting data.

1.7 User demand

Domestic users of annual GDP data are mainly government departments, research institutions, universities, industry associations, media and the public. In addition, the National Bureau of Statistics regularly provides China’s annual GDP data to international organizations such as the United Nations, the International Monetary Fund, the Organization for Economic Cooperation and Development, and the Asian Development Bank.

2. Annual GDP accounting method

2.1 classification system

In the annual GDP accounting, the industry classification is based on the China national economy industry classification standard and the third industry classification standard, and two classification methods are adopted.

The first classification is the national economic industry classification, which adopts the National Economic Industry Classification (GB/T 4754-2011) issued by the National Standards Administration in 2011. Two-level classification is adopted in actual accounting.

The first-level classification is based on the categories in the national economic industry classification, and it is divided into 11 industries, including agriculture, forestry, animal husbandry, fishery, industry, construction, wholesale and retail, transportation, warehousing and postal services, accommodation and catering, finance, real estate, information transmission, software and information technology services, leasing and business services, and other services. Among them, the industry includes mining, manufacturing, electricity, heat, gas and water production and supply industries; Other service industries include scientific research and technical services, water conservancy, environment and public facilities management, residential services, repairs and other services, education, health and social work, culture, sports and entertainment, public management, social security and social organizations. On the basis of the first classification, the second classification is subdivided into industry categories.

The difference between the industry classification of the preliminary accounting of annual GDP and the industry classification of the final verification of annual GDP is mainly due to the different degree of refinement of the second-level classification.

The second classification is the classification of tertiary industries, which is divided into primary industry, secondary industry and tertiary industry according to the Regulation on the Classification of Tertiary Industries formulated by the National Bureau of Statistics in 2012. The primary industry refers to agriculture, forestry, animal husbandry and fishery (excluding agriculture, forestry, animal husbandry and fishery services); The secondary industry refers to mining (excluding auxiliary mining activities), manufacturing (excluding metal products, machinery and equipment repair), electricity, heat, gas and water production and supply, and construction; The tertiary industry, namely the service industry, refers to other industries except the primary industry and the secondary industry (excluding international organizations).

2.2 Sources of information

The preliminary accounting of annual GDP adopts quarterly GDP accounting methods and data sources, and only the data sources of final verification of annual GDP are introduced here.

First, the national statistical survey data refers to all kinds of annual report data obtained from the statistical survey conducted by the national statistical system, including: agricultural, forestry, animal husbandry and fishery, industry, construction, wholesale and retail, accommodation and catering, real estate, service industries above designated size, household survey data, population and labor wage statistics, and price statistics.

Second, the annual financial statistics of the department refers to the annual financial statistics of the industry that are uniformly formulated by the National Bureau of Statistics and collected by relevant administrative departments and some state-owned enterprises, such as the annual financial statistics of affiliated enterprises or institutions summarized by the Ministry of Communications, the Health Planning Commission and Sinopec Group Corporation.

The third is the financial final accounts, which refers to the financial final accounts compiled by the Ministry of Finance and the financial final accounts of administrative institutions affiliated to the central department.

2.3 accounting methods

The annual GDP preliminary accounting method is the same as the quarterly GDP accounting method, so I won’t repeat it here. The following introduces the final verification method of annual GDP.

2.3.1 Accounting method of current value-added

The current added value of agriculture, forestry, animal husbandry and fishery is calculated by production method, and the current added value of other industries is calculated by income method.

2.3.2 Accounting method of constant price added value

The added value of constant prices by industry is calculated by the fixed base period method. At present, the base period is changed every five years, and the base period of constant price added value from 2016 to 2020 is 2015.

Annual constant price GDP accounting mainly adopts price index reduction method and volume index extrapolation method.

2.3.2.1 price index reduction method

Use the relevant price index to directly reduce the current price added value and calculate the constant price added value. The calculation formula is:

Constant price added value of an industry = current price added value of the industry ÷ price index of the industry.

Extrapolation method of 2.3.2.2 mass index

Calculate the growth rate of constant price added value by using the growth rate of related material indexes, and then calculate the current constant price added value of the industry by using the constant price added value of the previous year and the calculated growth rate of constant price added value. The calculation formula is:

Constant price added value of an industry = constant price added value of the industry in the previous year × (1+growth rate of constant price added value of the industry)

Among them, the growth rate of constant price added value is determined according to the growth rate of relevant volume indicators (such as transportation turnover, employees, etc.) in this period, and the quantitative relationship between the growth rate of constant price added value in previous years and the growth rate of relevant volume indicators.

3. Revision of annual GDP data

3.1 the necessity of revision

The preliminary accounting of annual GDP is very time-sensitive, and it is generally published about 20 days after the year. At this time, because a large number of annual financial data can’t meet the requirements of annual GDP accounting in time, the basic data on which the preliminary annual GDP figures are calculated are all monthly data and quarterly data, and the annual GDP data calculated according to this has a great calculation component. After that, with the continuous increase of basic data, especially the annual financial data, according to the common practice of various countries, GDP data should be revised in a timely manner based on more comprehensive and reliable basic data.

3.2 Revision procedure

According to the latest reform of GDP accounting and data release system of National Bureau of Statistics, China’s annual GDP accounting is divided into two steps: preliminary accounting and final verification, and final verification is the revision of preliminary accounting data. After the national economic census is carried out and new basic data that have great influence on GDP data are found, or the calculation method and classification standard have changed, the annual GDP historical data should also be revised.

4. Annual GDP data quality evaluation

4.1 Evaluation of basic data

For the professional statistical data and administrative record data used in GDP accounting, the relevant professional statistical departments and administrative departments will test their quality to ensure that the data reasonably reflect the actual situation of economic development. When the GDP accounting department gets these basic data, it will test the integrity, comparability and accuracy of the data again to ensure that these data meet the concepts and requirements of GDP accounting.

4.2 Evaluation of accounting methods

In the GDP accounting, the GDP accounting department will revise China’s annual GDP accounting method according to the constantly developing economic reality of China and the constantly improving international standards of national economic accounting, so as to ensure the rationality of the accounting method.

4.3 Evaluation of accounting results

After calculating the annual GDP data, it is necessary to test the coordination of GDP and its sub-data, GDP and other accounting data, GDP and related professional statistics and departmental statistics to ensure the coordination and matching of GDP data and other major related data.

4.4 Comparability of data

4.4.1 International comparability

The China National Economic Accounting System (2016) adopted the basic accounting principles, contents and methods of the United Nations National Accounts System (2008), so the GDP data is internationally comparable.

4.4.2 Comparability of time series

After a nationwide census or changes in calculation methods and classification standards, not only the GDP data of the current year are recalculated, but also the historical GDP data are revised. Therefore, the published annual GDP data time series since 1952 is comparable.

5. Annual GDP data release

5.1 Release time

The preliminary accounting data of annual GDP is generally released around January 20 of the following year, and the final verification data of annual GDP is released in January of the following year.

5.2 Release method

The preliminary accounting figures of annual GDP are published in the annual press conference on the operation of the national economy, the website of the National Bureau of Statistics, and the "China Economic Prosperity Monthly Report"; The final verification number of annual GDP is published on the website of the National Bureau of Statistics in the form of an announcement by the National Bureau of Statistics; At the same time, the final verification number of annual GDP is also published in the Statistical Abstract of China and the Statistical Yearbook of China every other year; The national statistical database will be updated simultaneously.

Chapter I General Provisions

  the first In order to ensure the security of key information infrastructure, these Regulations are formulated in accordance with the Cyber Security Law of the People’s Republic of China.

  the second These Regulations shall apply to the planning, construction, operation, maintenance and use of key information infrastructure and the security protection of key information infrastructure in People’s Republic of China (PRC).

  Article The security protection of key information infrastructure adheres to the principles of top-level design, overall protection, overall coordination and division of responsibilities, and gives full play to the role of the main body of operation, with the active participation of all sectors of society to jointly protect the security of key information infrastructure.

  Article 4 In accordance with the division of responsibilities stipulated by the State Council, the national industry supervisor or regulatory department is responsible for guiding and supervising the safety protection of key information infrastructure in this industry and field.

  The national network information department is responsible for coordinating the security protection of key information infrastructure and related supervision and management. The State Council public security, national security, national secrecy administration, national password management and other departments are responsible for the relevant network security protection and supervision and management within their respective responsibilities.

  The relevant departments of the local people’s governments at or above the county level shall carry out the security protection of key information infrastructure in accordance with the relevant provisions of the state.

  Article 5 Operators of key information infrastructure (hereinafter referred to as operators) are mainly responsible for the security of key information infrastructure of their own units, fulfill the obligation of network security protection, accept the supervision of the government and society, and assume social responsibilities.

  The state encourages network operators outside the key information infrastructure to voluntarily participate in the key information infrastructure protection system.

  Article 6 On the basis of the network security level protection system, key information infrastructure is protected.

  Article 7 Any individual or organization has the right to report to the departments of network information, telecommunications, public security, industry directors or regulatory authorities when it finds any behavior that endangers the security of key information infrastructure.

  The department that receives the report shall promptly deal with it according to law; If it does not belong to the responsibilities of this department, it shall be transferred to the department that has the right to handle it in time.

  The relevant departments shall keep confidential the relevant information of informants and protect their legitimate rights and interests.

Chapter II Support and Guarantee

  Article 8 The state takes measures to monitor, defend and deal with cyber security risks and threats originating from inside and outside People’s Republic of China (PRC), protect key information infrastructure from attack, intrusion, interference and destruction, and punish illegal and criminal activities on the Internet according to law.

  Article 9 The state formulates policies on industry, finance, taxation, finance and talents, supports the innovation of technologies, products and services related to the security of key information infrastructure, promotes safe and credible network products and services, trains and selects network security talents, and improves the security level of key information infrastructure.

  Article 10 The state establishes and improves the network security standard system, and uses standards to guide and standardize the security protection of key information infrastructure.

  Article 11 The people’s governments at or above the prefecture level shall incorporate the safety protection of key information infrastructure into the overall planning of regional economic and social development, increase investment, and carry out performance evaluation.

  Article 12 The state encourages government departments, operators, scientific research institutions, network security service institutions, industry organizations and network products and service providers to carry out security cooperation on key information infrastructure.

  Article 13 The national industry supervisor or regulatory department shall establish or specify the institutions and personnel specifically responsible for the security protection of key information infrastructure in this industry and field, compile and organize the implementation of network security planning in this industry and field, establish and improve the working fund guarantee mechanism and supervise the implementation.

  Article 14 Energy, telecommunications, transportation and other industries should provide key protection and support in power supply, network communication, transportation and other aspects for the emergency handling of network security incidents of key information infrastructure and the recovery of network functions.

  Article 15 Public security organs and other departments investigate and crack down on illegal and criminal activities carried out against and using key information infrastructure according to law.

  Article 16 No individual or organization may engage in the following activities and behaviors that endanger critical information infrastructure:

  (1) Attacking, invading, interfering with or destroying key information infrastructure;

  (2) illegally obtaining, selling or providing others with information such as technical data that may be specially used to endanger the security of key information infrastructure without authorization;

  (3) Conducting penetrating and aggressive scanning and detection of key information infrastructure without authorization;

  (4) Providing Internet access, server hosting, network storage, communication transmission, advertising promotion, payment and settlement, etc. to others knowing that they are engaged in activities that endanger the security of key information infrastructure;

  (five) other activities and behaviors that endanger key information infrastructure.

  Article 17 The state maintains network security based on an open environment and actively carries out international exchanges and cooperation in the field of key information infrastructure security.

Chapter III Scope of Key Information Infrastructure

  Article 18 Once the network facilities and information systems operated and managed by the following units are damaged, lose their functions or have data leaked, which may seriously endanger national security, the national economy and people’s livelihood and public interests, they shall be included in the protection scope of key information infrastructure:

  (a) government agencies and units in energy, finance, transportation, water conservancy, health care, education, social security, environmental protection, public utilities and other industries;

  (2) Information networks such as telecommunication networks, radio and television networks and the Internet, and units that provide cloud computing, big data and other large-scale public information network services;

  (three) scientific research and production units in the fields of national defense science and technology, large-scale equipment, chemical industry, food and medicine;

  (4) news organizations such as radio stations, television stations and news agencies;

  (5) Other key units.

  Article 19 The national network information department shall, jointly with the telecommunications authorities of the State Council and the public security departments, formulate guidelines for the identification of key information infrastructure.

  The national industry director or regulatory department shall, in accordance with the guidelines for the identification of key information infrastructures, organize the identification of key information infrastructures in the industry and field, and submit the identification results according to procedures.

  In the process of key information infrastructure identification, we should give full play to the role of relevant experts to improve the accuracy, rationality and scientificity of key information infrastructure identification.

  Article 20 If the key information infrastructure is newly built or shut down, or there is a major change in the key information infrastructure, the operator shall promptly report the relevant situation to the national industry supervisor or regulatory department.

  The national industry supervisor or regulatory department shall make timely identification and adjustment according to the situation reported by the operator, and submit the adjustment according to the procedure.

Chapter IV Safety Protection of Operators

  Article 21 The construction of key information infrastructure should ensure that it has the performance of supporting the stable and continuous operation of business, and ensure the synchronous planning, simultaneous construction and simultaneous use of safety technical measures.

  Article 22 The main person in charge of the operator is the first person in charge of the security protection of the key information infrastructure of the unit, responsible for establishing and improving the network security responsibility system and organizing its implementation, and fully responsible for the security protection of the key information infrastructure of the unit.

  Article 23 Operators shall, in accordance with the requirements of the network security level protection system, perform the following security protection obligations, protect key information infrastructure from interference, destruction or unauthorized access, and prevent network data from leaking or being stolen or tampered with:

  (a) to formulate internal safety management systems and operating procedures, and strictly enforce identity authentication and authority management;

  (two) to take technical measures to prevent computer viruses and network attacks, network intrusion and other acts that endanger network security;

  (3) Take technical measures to monitor and record the network operation status and network security incidents, and keep relevant network logs for not less than six months according to regulations;

  (four) take measures such as data classification, important data backup and encryption authentication.

  Article 24 In addition to Article 23 of these regulations, operators shall also perform the following safety protection obligations in accordance with the provisions of national laws and regulations and the mandatory requirements of relevant national standards:

  (a) set up a special network security management organization and a person in charge of network security management, and conduct security background review on the person in charge and key positions;

  (2) Conducting cyber security education, technical training and skill assessment for employees on a regular basis;

  (three) to make disaster-tolerant backups of important systems and databases, and take remedial measures for security risks such as system loopholes in time;

  (four) to formulate emergency plans for network security incidents and conduct regular drills;

  (5) Other obligations stipulated by laws and administrative regulations.

  Article 25 The person in charge of network security management of the operator shall perform the following duties:

  (a) to organize the formulation of network security rules and regulations, operating procedures and supervise the implementation;

  (2) Organizing the skill assessment of personnel in key positions;

  (three) to organize the formulation and implementation of the network security education and training plan of the unit;

  (4) Organizing network security inspections and emergency drills to deal with and handle network security incidents;

  Article 27 Operators shall organize network security education and training for employees, and the duration of education and training shall not be less than 1 working day per person per year, and the duration of education and training for professional and technical personnel in key positions shall not be less than 3 working days per person per year.

  Article 28 Operators should establish and improve the safety inspection and evaluation system of key information infrastructure, and conduct safety inspection and evaluation before the key information infrastructure is put into operation or when there are major changes.

  Operators shall, by themselves or by entrusting network security service agencies, conduct at least one inspection and evaluation on the security of key information infrastructure and possible potential risks every year, make timely rectification on the problems found, and report the relevant information to the national industry supervisor or regulatory department.

  Article 29 Personal information and important data collected and generated by operators in People’s Republic of China (PRC) shall be stored in China. If it is really necessary to provide it overseas due to business needs, it shall be assessed in accordance with the exit safety assessment method for personal information and important data; Where laws and administrative regulations provide otherwise, such provisions shall prevail.

Chapter V Safety of Products and Services

  Article 30 The key network equipment and special products for network security purchased and used by operators shall comply with the provisions of laws and administrative regulations and the mandatory requirements of relevant national standards.

  Article 31 Operators purchasing network products and services, which may affect national security, shall pass the network security review in accordance with the requirements of the network products and services security review measures, and sign a security confidentiality agreement with the provider.

  Article 32 Operators shall conduct safety inspection on outsourced systems, software and donated network products before they go online for application.

  Article 33 Operators found that the use of network products, services, such as security defects, loopholes and other risks, should take timely measures to eliminate potential risks, involving major risks should be reported to the relevant departments in accordance with the provisions.

  Article 34 The operation and maintenance of key information infrastructure should be implemented within the territory. If it is really necessary to carry out overseas remote maintenance due to business needs, it shall be reported to the national industry supervisor or regulatory department and the public security department of the State Council in advance.

  Article 35 Institutions that conduct security detection and assessment for key information infrastructure, release information on security threats such as system vulnerabilities, computer viruses and network attacks, and provide services such as cloud computing and information technology outsourcing shall meet the relevant requirements.

  The specific requirements shall be formulated by the national network information department in conjunction with the relevant departments of the State Council.

Chapter VI Monitoring and Early Warning, Emergency Disposal and Detection and Evaluation

  Article 36 The national network information department will co-ordinate the establishment of a network security monitoring and early warning system and information notification system for key information infrastructure, organize and guide relevant institutions to carry out network security information summary, analysis, judgment and notification, and uniformly release network security monitoring and early warning information in accordance with regulations.

  Article 37 The national industry supervisor or regulatory department shall establish and improve the network security monitoring, early warning and information notification system for key information infrastructure in this industry and field, keep abreast of the operation status and security risks of key information infrastructure in this industry and field, and inform relevant operators of security risks and related work information.

  The national industry director or regulatory department shall organize the research and judgment of safety monitoring information, and if it deems it necessary to take immediate preventive measures, it shall timely release early warning information and emergency preventive measures and suggestions to the relevant operators, and report to the relevant departments in accordance with the requirements of the national emergency plan for cyber security incidents.

  Article 38 The national network information department coordinates relevant departments, operators, relevant research institutions and network security service institutions to establish a network security information sharing mechanism for key information infrastructure to promote network security information sharing.

  Article 39 The national network information department shall, in accordance with the requirements of the national network security emergency plan, coordinate relevant departments to establish and improve the network security emergency cooperation mechanism for key information infrastructure, strengthen the construction of network security emergency forces, and guide and coordinate relevant departments to organize cross-industry and cross-regional network security emergency drills.

  The national industry supervisor or regulatory department shall organize the formulation of emergency plans for cyber security incidents in its own industry and field, and organize regular drills to enhance its ability to respond to cyber security incidents and recover from disasters. After the occurrence of major network security incidents or receiving early warning information from the network information department, the emergency plan should be immediately launched to organize the response, and the relevant situation should be reported in time.

  Article 40 The national industry director or regulatory department shall regularly organize spot checks on the security risks of key information infrastructure in this industry and field and the performance of operators’ security protection obligations, put forward improvement measures, and guide and urge operators to rectify the problems found in the detection and evaluation in a timely manner.

  The national network information department co-ordinates the spot check and testing work carried out by relevant departments to avoid cross-examination and evaluation.

  Article 41 Relevant departments should adhere to the principles of objectivity, fairness, efficiency and transparency, adopt scientific testing and evaluation methods, standardize testing and evaluation processes, and control testing and evaluation risks.

  The operator shall cooperate with the inspection and evaluation carried out by the relevant departments according to law, and timely rectify the problems found in the inspection and evaluation.

  Article 42 The relevant departments shall organize the safety inspection and evaluation of key information infrastructure, and may take the following measures:

  (a) require the relevant personnel of the operator to explain the testing and evaluation matters;

  (2) Consulting, retrieving and copying documents and records related to security protection;

  (three) to check the formulation and implementation of network security management system and the planning, construction and operation of network security technical measures;

  (four) the use of testing tools or entrust network security service agencies to carry out technical testing;

  (five) other necessary means with the consent of the operator.

  Article 43 The information obtained by relevant departments and network security service institutions in the security detection and evaluation of key information infrastructure can only be used for the needs of maintaining network security and shall not be used for other purposes.

  Article 44 The relevant departments shall organize the safety inspection and evaluation of key information infrastructure, and shall not charge the inspected and evaluated units, and shall not require the inspected and evaluated units to purchase the products and services of designated brands or designated production and sales units.

Chapter VII Legal Liability

  Article 45 If the operator fails to perform the network security protection obligations stipulated in the first paragraph of Article 20, Article 21, Article 23, Article 24, Article 26, Article 27, Article 28, Article 30, Article 32, Article 33 and Article 34 of these Regulations, the relevant competent department shall order it to make corrections according to its duties and give it a warning; Those who refuse to correct or lead to the consequences of endangering network security shall be fined not less than 100,000 yuan but not more than 1 million yuan, and those directly in charge shall be fined not less than 10,000 yuan but not more than 100,000 yuan.

  Article 46 Operators who, in violation of the provisions of Article 29 of these regulations, store network data overseas or provide network data overseas, shall be ordered by the relevant competent departments of the state to make corrections according to their duties, given a warning, confiscate their illegal income, and be fined not less than 50,000 yuan but not more than 500,000 yuan, and may be ordered to suspend related businesses, suspend business for rectification, close websites and revoke related business licenses; The directly responsible person in charge and other directly responsible personnel shall be fined between 10,000 yuan and 100,000 yuan.

  Article 47 In violation of the provisions of Article 31 of these regulations, operators use network products or services that have not passed the security review or security review, and the relevant competent departments of the state shall order them to stop using them according to their duties, and impose a fine of more than one time and less than ten times the purchase amount; The directly responsible person in charge and other directly responsible personnel shall be fined between 10,000 yuan and 100,000 yuan.

  Article 48 Individuals who violate the provisions of Article 16 of these regulations and do not constitute a crime shall be confiscated by the public security organs, detained for less than five days, and may be fined not less than 50,000 yuan but not more than 500,000 yuan; If the circumstances are serious, they shall be detained for more than five days and less than fifteen days, and may be fined not less than one hundred thousand yuan but not more than one million yuan; If a crime is constituted, criminal responsibility shall be investigated according to law.

  If a unit commits the acts mentioned in the preceding paragraph, the illegal income shall be confiscated by the public security organ, and a fine of not less than 100,000 yuan but not more than 1 million yuan shall be imposed, and the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the provisions of the preceding paragraph.

  In violation of the provisions of article sixteenth of this Ordinance, the person who is subject to criminal punishment shall not engage in the work of key information infrastructure security management and network operation key positions for life.

  Article 49 Operators of key information infrastructure of state organs fail to fulfill the obligations of network security protection stipulated in these regulations, and shall be ordered by their higher authorities or relevant authorities to make corrections; The directly responsible person in charge and other directly responsible personnel shall be punished according to law.

  Article 50 The relevant departments and their staff have one of the following acts, and the directly responsible person in charge and other directly responsible personnel shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

  (1) Soliciting and accepting bribes by taking advantage of one’s authority at work;

  (two) dereliction of duty, abuse of power;

  (three) unauthorized disclosure of key information infrastructure related information, data and data files;

  (four) other acts in violation of statutory duties.

????Article 51 If a major network security incident occurs in the key information infrastructure, which is determined as a liability accident after investigation, the responsibility of the operating unit should be ascertained and investigated according to law, and the responsibility of the relevant network security service institutions and relevant departments should also be ascertained. Those who have dereliction of duty, dereliction of duty and other illegal acts should be investigated according to law.

  Article 52 Overseas institutions, organizations and individuals engaged in attacks, intrusions, interference, destruction and other activities that endanger People’s Republic of China (PRC)’s key information infrastructure, resulting in serious consequences, shall be investigated for legal responsibility according to law; The public security departments, state security organs and relevant departments of the State Council may also decide to freeze assets or take other necessary sanctions against the institution, organization or individual.

Chapter VIII Supplementary Provisions

  Article 53 The security protection of key information infrastructure for storing and processing state secret information shall also comply with the provisions of confidentiality laws and administrative regulations.

  The use and management of passwords in key information infrastructure shall also comply with the provisions of password laws and administrative regulations.

????Article 54 The security protection of military key information infrastructure shall be stipulated separately by the Central Military Commission (CMC).

Guidelines for the general election of social organizations in Beijing (for Trial Implementation)

Chapter I General Provisions

  Article 1 In order to regulate the general election of social organizations, ensure members to exercise their democratic rights according to law, and promote autonomy according to law, these guidelines are formulated in accordance with the Regulations on the Administration of Registration of Social Organizations and relevant laws, regulations and policies, combined with the actual work in our city.

  Article 2 The general election of social organizations (hereinafter referred to as the general election) is a process in which the organization holds a general meeting or a general meeting of members (hereinafter referred to as the general meeting) in accordance with the articles of association, deliberates and votes on relevant matters in accordance with the prescribed procedures, and elects a new board of directors and board of supervisors by voting.

  Article 3 The general election shall embody the principles of "democracy, openness, fairness, impartiality and standardization".

  Article 4 The general election of social organizations shall be the responsibility of the Council or the Standing Council (hereinafter referred to as the Council).

  The Council may establish a general election committee and authorize the general election committee to be solely responsible for the general election.

  Article 5 The competent business units, leading organs of Party building and registration administration organs shall be responsible for the guidance and supervision of the general election.

  Article 6 These Guidelines shall apply to social organizations registered in the civil affairs department of this Municipality according to law.

Chapter II General Election Institutions

  Article 7 The Council shall organize the general election six months before the expiration of its term of office. The duties of the Council are:

  (a) to formulate the work plan for the general election and hold regular meetings to study and discuss major issues in the general election.

  (2) Organizing to sort out the membership roster and examining the membership conditions according to the articles of association.

  When a member congress is held, it is necessary to draw up and adopt the method for generating member representatives, and review and approve the list of member representatives.

  (3) Organizing the nomination of the chairman or president (hereinafter referred to as the chairman), the vice-chairman or vice-chairman (hereinafter referred to as the vice-chairman), the chairman of the board of supervisors, the secretary-general, the standing directors, directors and supervisors to propose candidates. Have a part-time job, for examination and approval for the record.

  (four) to discuss and pass the relevant materials for the general election.

  (five) to submit the general election materials and the list of candidates for the responsible person to the competent business units, the leading organs of party building and the registration administration organs.

  Article 8 Where the general election committee is authorized to be established, the Council shall establish the general election committee six months before the expiration of its term of office.

  The general election committee is elected by the Council. Generally, it is composed of the principal person in charge of the board of directors, the person in charge of the party organization at the same level, the executive director, the representative of the director and the representative of the supervisor. The number of members is determined by the board of directors, which is generally odd, and the number is 5-15. The general election committee shall elect a chairman, and the leading office or secretariat shall carry out the work related to the general election.

  After the election committee is formed, it shall issue an announcement to inform all members.

Chapter III Membership Examination

  Article 9 Before the general election, membership examination shall be conducted to ensure that members have the right to vote, be elected and vote. Members who fail to pay their membership fees, participate in activities or violate the articles of association are advised to cancel their membership, which will be discussed and approved by the board of directors. Those who cancel without discussion and approval by the Council still enjoy membership rights.

  Article 10 A new application for membership shall be discussed and approved by the board of directors.

  Article 11 The board of directors or the general election committee shall draw up the Membership List and publicize it in an appropriate way for 7 days.

  Twelfth members have objections to the publicity of the "membership list", should be within 10 days after the publicity to the Council or the general election committee. The Council or the general election committee shall conduct investigation and verification within 3 days after receiving the objection application. If it needs to be corrected, the corrected "Member List" shall be publicized in time.

Chapter IV Selection of Member Representatives

  Article 13 In principle, a general meeting shall be held if the number of members is less than 200 (inclusive). If there are more than 200 members, a member representative meeting may be held, and the number of member representatives is generally not less than 50.

  Article 14 The proportion of member representatives shall be determined according to industry category, geographical distribution and representativeness.

  Members’ representatives shall be elected through democratic means. After the members’ representatives are produced, they shall be reported to the Council or the general election committee for deliberation and approval.

  The person in charge of a corresponding party organization should generally be a member representative.

  Article 15 The board of directors or the general election committee shall summarize and form a Member Representative List, and publicize it in an appropriate way before the general election, with a publicity period of 7 days.

  Sixteenth members of the publicity of the "Member Representative List" have objections, should be within 10 days after the publicity to the Council or the general election committee. The Council or the general election committee shall conduct investigation and verification within 3 days after receiving the objection. If it needs to be corrected, the corrected "Member Representative List" shall be publicized in time.

Chapter V Generation of Candidates

  Article 17 The board of directors or the general election committee shall, on the basis of extensive consultation, nominate candidates for chairman, vice-chairman, executive director, director, secretary-general, chairman of the board of supervisors and supervisor by means of holding a forum, making a thorough investigation, and recommending by the board of directors.

  Article 18 Selection of directors, executive directors and supervisors.

  (1) The directors are elected from among the members, and the board of directors is composed of at least 7 directors and no more than 100 directors, generally not more than one third of the members or their representatives. The term of office of directors is stipulated in the articles of association.

  (2) The executive director shall be elected from among the directors, and the executive council shall be composed of at least 5 executive directors, with a maximum of 1/3 of the directors. The term of office of the executive director shall be stipulated in the articles of association.

  Social organizations with less than 50 directors do not have a standing Council; Social organizations with more than 50 directors may set up a standing council.

  (3) The supervisors shall be elected from among the members, and the board of supervisors shall consist of at least three supervisors. The term of office of the supervisor shall be stipulated in the articles of association.

  Article 19 Selection of the person in charge.

  (1) The chairman, vice-chairman and secretary-general are elected from among the directors, and the number generally does not exceed one third of the number of directors. Generally, there is one chairman, several vice-chairmen and one secretary-general.

  The Secretary-General can also implement the appointment system, and his term of office is not limited, and he cannot serve as the legal representative.

  (2) The chairman of the board of supervisors shall be elected from among the supervisors, with one person.

  Article 20 A person in charge of a social organization shall meet the following basic qualifications:

  (1) Adhere to the leadership of the Communist Party of China (CPC), implement the Supreme Leader’s Socialism with Chinese characteristics Thought in the new era, support Socialism with Chinese characteristics, and resolutely implement the party’s line, principles and policies;

  (two) law-abiding, diligent, personal social credit record is good;

  (three) have the corresponding professional knowledge, experience and ability, familiar with the industry;

  (4) Being in good health and able to perform their duties normally, each term of office shall not exceed five years, and the term of re-election shall not exceed two, and the maximum working age shall not exceed 70 years. The legal representative shall not serve as the legal representative of other social organizations at the same time;

  (5) Having full capacity for civil conduct;

  (six) there are no laws and regulations prohibiting other circumstances.

  Twenty-first general election 15 days ago, the "list of candidates" should be publicized to all members, and the publicity period is 7 days.

  Twenty-second members of the publicity of the "list of candidates" have objections, should be within 7 days after the publicity to the Council or the general election committee. The Council or the general election committee shall conduct investigation and verification within 3 days from the date of receiving the objection. If it needs to be corrected, the corrected List of Candidates’ Suggestions shall be publicized in time.

Chapter VI General Audit

  Article 23 The board of directors or the general election committee shall select a qualified accounting firm to issue the General Audit Report, and the audit period shall generally be from the establishment of the current board of directors to three months before the next general meeting.

  Article 24 If the legal representative leaves office, the board of directors or the general election committee shall select a qualified professional audit institution to issue the Audit Report on the Economic Responsibility of the Legal Representative during his term of office, and the report shall indicate a clear audit conclusion. The audit period is generally from the legal representative’s term of office to three months before the next general meeting.

Chapter VII Consideration of Documents

  Article 25 The Council or the general election committee shall hold a meeting 60 days before the general election meeting to consider and pass the following materials:

  (1) Nomination of candidates for chairman, vice chairman, secretary-general, supervisor, executive director, director and supervisor;

  (two) the political audit materials of the candidates for the heads of social organizations without business units;

  (3) Roster of Honorary Personnel (involving this content);

  (4) Application for General Election;

  (5) Work Report of the Board of Directors, Financial Work Report and Work Report of the Board of Supervisors;

  (6) Agenda of the General Assembly;

  (7) Measures for General Election (Draft);

  (eight) to prepare the ballot sample;

  (9) Articles of Association (Draft) and Comparison Table of New and Old Articles of Association;

  (ten) on-the-job leading cadres, retired (retired) cadres part-time approval and filing materials.

Chapter VIII Materials Submitting for Approval

  Twenty-sixth according to the relevant provisions, the board of directors or the general election committee will report the materials reviewed and approved to the competent business unit for approval. Social organizations without competent business units shall report to the leading organs of Party building for examination and approval in accordance with the "Measures for the Examination of Persons in Charge of Chambers of Commerce of Beijing Industry Associations (Trial)".

  Twenty-seventh leading cadres of the party and government organs shall be examined and approved in accordance with the requirements of the Municipal Commission for Discipline Inspection and the Organization Department of the Municipal Party Committee.

  Twenty-eighth according to the relevant provisions, the board of directors or the general election committee will report the approved materials to the registration authority for review.

Chapter IX Election Preparation

  Twenty-ninth meeting notice. The board of directors or the general election committee shall notify all members or members’ representatives in an appropriate way one week before the general election meeting is held. The contents of the notice mainly include: the time and place of the general election and the agenda of the meeting.

  Article 30 Print ballot papers. The Council or the general election committee shall print at least two sets of official ballots, which shall be distinguished by eye-catching colors, and the official ballots shall be stamped with the official seal of social organizations and sealed.

  Article 31 proxy voting. Members or member representatives who are unable to vote on the day of the meeting may entrust others to vote in writing.

  The proxy voting shall be made public to members in an appropriate way and subject to supervision.

  Article 32 Making ballot boxes. The front of the ballot box should be marked with the words "ballot box", which should be easy to seal and lock, and the voting opening should not be too large. The ballot box should be of moderate size, so that it is convenient for voting and election staff to move it.

  Thirty-third determine the candidates recommended by the scrutineers and tellers.

  (1) The board of directors or the Election Committee shall nominate from the staff of the Secretariat, members or members’ representatives one candidate recommended by the chief scrutineer, and several candidates recommended by the tellers and scrutineers.

  (2) A candidate shall not be the chief scrutineer, scrutineer or teller.

  (3) After nomination, the board of directors or the general election committee shall provide them with necessary pre-election training, including voting methods, provisions and drawing methods of ballots, counting methods, determination of validity and invalidity of ballots and other matters needing attention.

  Article 34 Arrange the meeting place. The venue layout should be solemn and grand. The emblem should be hung above the venue. Ballot boxes should be set up at the venue to facilitate queuing for tickets, drawing tickets and voting, so as to ensure the orderly voting.

  Article 35 Prepare articles for the conference. The items needed for the general election meeting mainly include: materials to be considered by the meeting, sign-in form, member (representative) roster, ballot papers, vote counting form, national anthem CD, election result report form, etc.

  Thirty-sixth determine the host. The General Assembly shall be presided over by the Council or the general election committee. The moderator is generally the Secretary-General. If the Secretary-General is unable to serve, the Council or the general election committee shall recommend a vice-chairman.

Chapter X General Election

The first section is valid

  Article 37 Before the start of the general election meeting, the Council or the general election committee shall count the number of members or their representatives present at the meeting. If the number of members or their representatives present at the meeting exceeds two thirds of the number of members or their representatives present at the meeting, the meeting will be an effective meeting.

  The moderator should inform the conference.

Section 2 deliberation and voting

  Article 38 The General Assembly shall deliberate and vote on important materials such as the Work Report of the Board of Directors, the Work Report of the Board of Supervisors, the Financial Work Report, the Audit Report for the General Election, the Articles of Association (Draft), the Election Measures and other major issues. The General Assembly generally follows the following procedures when voting on relevant matters:

  (1) Deliberating and voting on the Work Report of the Council.

  (2) Deliberating and voting on the Financial Work Report.

  (three) review the "audit report", the legal representative should also read the "audit report on the economic responsibility of the legal representative’s term".

  (IV) Deliberating and voting on the Work Report of the Board of Supervisors.

  (5) Introduce the revision of the Articles of Association and vote on the Draft Articles of Association.

  (6) Deliberating and voting on the Election Measures, and voting on the chief scrutineer, scrutineer and teller.

  Thirty-ninth deliberation and voting methods should follow the principles of democracy and effectiveness, and generally vote by show of hands. When deliberating and voting, the host should ask and announce the consent, disagreement and abstention on the spot. The number of people who agree to vote exceeds two-thirds of the number of people present at the meeting. If the vote is not passed, the Council or the general election committee shall decide whether to re-vote or choose a date to vote. In case of unsuccessful voting, directors and supervisors cannot be elected.

Section 3 Election Voting

  Article 40 The election of directors and supervisors in the general meeting shall be presided over by the director. The chief scrutineer shall fill in the notes on the ballot papers, announce the discipline of the venue, supervise the voting, count the votes and report the votes.

  Forty-first general elections generally implement equal elections, and the number of candidates for the Council is the same as the number of candidates to be elected.

  Encourage the election by means of difference, and if the election is conducted by means of difference, the difference ratio shall not be less than one third.

  Social organizations can also adopt the method of direct election, and the members’ meeting directly elects directors, supervisors and principal responsible persons. If the general assembly is directly elected, the election process shall refer to the election process of the general election assembly.

  Article 42 The election of directors and supervisors generally follows the following procedures:

  (1) Introduce the procedures and conditions for the selection of candidates for directors and supervisors.

  (two) the scrutineer checks the ballot box and closes it on the spot.

  (3) The tellers issue ballots and report the actual number of ballots (the remaining ballots shall be sealed or destroyed in public).

  (four) to introduce the methods and matters needing attention in filling in the ballot paper.

  (5) Fill in the ballot paper.

  (6) voting. The chief scrutineers, scrutineers and tellers who are qualified as members (representatives) shall vote first, and other personnel shall vote in turn.

  (7) ticket inspection. The scrutineers and tellers will open the boxes to check the votes on the spot and report the number of votes withdrawn (the election is valid if the number of votes withdrawn is equal to or less than the number of votes issued).

  (8) Counting votes. The number of people (including the number of other candidates) selected for each ballot is equal to or less than the number of people to be elected, and the number of people who are more than the number of people to be elected is invalid.

  Candidates and other candidates can only be elected if the number of votes in favor exceeds two-thirds of the total number of members present or members’ representatives.

  The Council or the general election committee shall determine the validity of the ballot papers that cannot be determined.
